Franchise Disclosure Register
There is now a Franchise Disclosure Register which must be completed by Franchisors.
Below is the link to access the register.
https://franchisedisclosure.gov.au/
You will be required to create a franchise profile on the register using a digital identity through a mygovID account (this is different to your usual mygov) and grant access to your entity through your entity RAM (Relationship Authorisation Manager) system. There are guides on how to complete this through the above link. Note: if you operate more than one region/division under different entities, you will need to create a login for each entity.
Once you have gained access to the register, you will be required to enter your franchisor contact details and create a franchise profile (If you operate more than one region/division which sells franchises, you will need to create register franchise profile for each region).
Attached is a guide to assist you with creating your franchise profile for reference.
The Business Details are compulsory fields and will need to be completed.
If you are unsure on your ANZSIC division and subdivision, please check with your accountant what divisions your ABN is registered under or you can search following the below guide:
The Disclosure Information are compulsory fields and should match what is completed in your regional disclosure document and key facts sheet.
If you wish to have regional disclosure document template to upload, please contact documents@jims.net and request a template which the team can create and provide to you. There are some rules on sensitive information which needs to be redacted set out below:
(2) Before the franchisor provides the document or link for inclusion in the Register, the franchisor:
(a) must redact from the document the following kinds of information:
(i) personal information that relates to an individual other than the franchisor;
(ii) information that relates to a particular franchisee or a particular site being occupied by a franchisee; and
(b) may redact from the document information that is of a commercial nature and is commercially sensitive.
You will be required to do this once the documents team have supplied you with your regional disclosure document template.
Below is also a link which has the National Disclosure Document (to a prospective franchisee) and generic Franchise Agreement which you can add to your profile.
The Public Contact Details are compulsory fields and will need to be completed.
You can save your progress at any time while completing and once finalised you can publish the final version (please note this has to be confirmed or updated in accordance with the Franchising Code by 14th of November each year).
Please remember you as franchisor are fully responsible for your profile and we strongly recommend you seek independent advice to ensure the content accurately reflects your entity and circumstances properly.
